Terms of Service

1. Introduction
These Terms of Service ("Terms") govern your use of propkt, a property management tool operated as a sole trader in Queensland, Australia. By accessing or using propkt, you agree to be bound by these Terms. If you do not agree, do not use the service.

2. The Service
propkt is a property management, financial tracking, and tax deduction tracking tool designed for landlords. It helps you record rental income, expenses, tenant details, lease information, and documents, and generates summaries and reports based on the data you enter.
3. Not Professional Advice - Important
propkt is a record-keeping and tracking tool only.
- propkt does not provide financial, tax, legal, or accounting advice.
- All calculations, reports, depreciation schedules, summaries, and categorisations are guides only.
- You must consult a qualified professional (such as an accountant, registered tax agent, or financial advisor) before making any decisions based on data or outputs from propkt.
- propkt is not liable for any loss, damage, or penalty arising from your reliance on its outputs.
4. No Warranty on Calculations or Outputs
- propkt may contain errors in its calculations, formulas, depreciation schedules, tax categorisations, summaries, and reports.
- We do not warrant that any calculation or output produced by propkt is correct, complete, or current.
- Tax rules, depreciation rates, and regulations change. propkt may not reflect the latest changes immediately or at all.
- You must independently verify all figures with a qualified professional before relying on them for any purpose, including tax filings.
- All data entered into propkt and all outputs generated by propkt are guides only and must be independently verified.
5. Accuracy of User Data
You are responsible for the accuracy of the data you enter into propkt. propkt performs calculations and generates reports based on your input and makes no guarantees about the correctness of the results. You are solely responsible for any actions you take or decisions you make based on information, calculations, reports, or other outputs provided by propkt.
6. Changes to the Service
- Features may be changed, added, or removed at any time.
- Calculation methods, depreciation rules, and categorisation logic may be updated without notice.
- We will make reasonable efforts to notify you of material changes.
- We are not liable for any impact that changes to the service may have on past calculations, reports, or data.
7. Account and Security
You are responsible for maintaining the security of your account. You must provide accurate information when creating your account and keep your authentication credentials secure. Each person may only maintain one account.
8. Payments and Subscriptions
- Payments are processed securely by Stripe. We do not store your payment card details.
- Subscription plans and pricing may change. We will give you reasonable notice of any price changes before they take effect.
- Refunds are handled at propkt's discretion on a case-by-case basis.
- Access to paid features may be restricted if payment fails or your subscription lapses.
9. Acceptable Use
You agree not to:
- Use propkt for any unlawful purpose or in violation of any applicable laws
- Attempt to interfere with, disrupt, or exploit the service or its infrastructure
- Access or attempt to access another user's account or data
- Use automated tools to scrape, crawl, or extract data from propkt without permission
10. Limitation of Liability
To the maximum extent permitted by Australian Consumer Law:
- propkt is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.
- We are not liable for any direct, indirect, incidental, or consequential loss or damage arising from your use of propkt, including but not limited to: financial loss, incorrect tax filings, missed deductions, penalties from tax authorities, decisions made using propkt data, errors in calculations, reports, or outputs, software defects or bugs, service interruptions or downtime, loss or corruption of data, or changes to features or functionality.
- Our maximum aggregate liability for any claim arising from or related to propkt is limited to the total fees you have paid to us in the 12 months immediately preceding the claim.
11. Indemnification
You agree to indemnify and hold propkt harmless from any claims, losses, liabilities, damages, costs, or expenses (including reasonable legal fees) arising from your use of the service, your breach of these Terms, or your reliance on any data or outputs produced by propkt.
12. Dispute Resolution
- If a dispute arises, both parties agree to first attempt to resolve it through good faith negotiation.
- If the dispute is not resolved within 30 days, it will be submitted to mediation in Queensland, Australia.
- If mediation fails, the dispute will be subject to the exclusive jurisdiction of the courts of Queensland, Australia.
13. Termination
- We may suspend or terminate your account if you breach these Terms or engage in conduct that we determine is harmful to propkt or other users.
- You may delete your account at any time through the app or by contacting us.
- Upon termination, your data will be handled in accordance with our Privacy Policy.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of Queensland, Australia. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee or right under the Australian Consumer Law that cannot be excluded, restricted, or modified by agreement.
