Rent Increase Rules WA

Western Australia pairs a 60-day notice requirement with the strictest form rule in the country: the notice MUST be given on Consumer Protection's Form 10, and Form 10 only prints weekly rent amounts. Landlords of fortnightly or monthly tenancies need to convert the figures before serving.

Form 10's amount boxes are printed 'per week'. A notice that misstates the rent period, or leaves both amount boxes empty, is worse than no notice - Consumer Protection's advice line is 1300 30 40 54 where a tenancy is not paid weekly.

A Perth tenant pays $640 per fortnight. The landlord wants a 4% increase to start on 1 March.

Form 10 asks for both the increase amount and the new total weekly rent. State both boxes in weekly figures even though the tenant pays fortnightly.

Frequently asked questions

Is Form 10 mandatory for rent increases in WA?

Yes. Since the July 2024 reforms, a rent increase notice is only valid if it is given in writing on the approved Form 10 (Form RP10 in residential parks). A letter or email that is not the prescribed form does not give valid notice.

My tenant pays fortnightly. How do I fill in Form 10?

Convert the figures to weekly amounts - divide the fortnightly rent by two - because Form 10's printed fields state rent 'per week'. Both the dollar increase and the new total must be weekly figures. Call Consumer Protection on 1300 30 40 54 if unsure.

How often can rent be increased in Western Australia?

No more than once every 12 months, for both periodic and fixed-term agreements. This replaced the old six-month rule when the reforms commenced on 29 July 2024.

How much notice is required in WA?

At least 60 days of written notice before the increase takes effect, remembering postal service needs extra delivery time.

Can a WA tenant dispute a rent increase?

Yes. Either party can apply to the Magistrates Court, including for a rent reduction order or against a proposed increase considered excessive.
