Foreign purchaser surcharge: 8% additional duty

Foreign persons buying residential-related property in NSW pay surcharge purchaser duty of 9% of the dutiable value on top of standard transfer duty. Permanent residents generally become exempt after 12 months of continuous residence.

Duty scales are indexed each year in line with CPI. The thresholds below apply to contracts dated on or after 1 July 2026.

How is stamp duty calculated in NSW?

NSW uses a progressive scale set by Revenue NSW. Each portion of the purchase price is taxed at its own marginal rate, so a $850,000 purchase pays $11,602 on the first $387,000 band plus 4.5 cents per dollar above it. The calculator above runs the current 2026-27 table for you.

Do first home buyers pay stamp duty in NSW?

Under the First Home Buyers Assistance Scheme, eligible buyers pay no transfer duty on homes up to $800,000 and a tapered concession between $800,000 and $1,000,000. You must move in within 12 months and live there for at least 12 months to keep the exemption.

What is the foreign purchaser surcharge in NSW?

Foreign buyers pay an extra 8% surcharge purchaser duty on top of standard transfer duty, taking the top combined rate to about 16%. Australian citizens, permanent residents who meet the residency test, and New Zealand citizens holding a 444 visa are generally not foreign persons for surcharge purposes.

When does NSW stamp duty have to be paid?

Transfer duty is due within three months of the contract date, though in practice it is paid at settlement from your loan and cash funds. Revenue NSW charges interest and penalty tax on late payment.
